the above suit against Defendants praying that it be declared
by order and direction of this Honourable Court that the
tenancy of the Defendant in respect of Suit Premises being

Road, Matunga, Mumbai-400019, admeasuring

bounded on or towards East by Room no. 17, on or towards
the West by Dr. Ambedkar Road, on or towards the North by
Room No.2, and on or towards the South by Bhuta Niwas
Building No. 2, situated upon the Suit Property, stands
terminated and that the Plaintiffs are entitled to order and
direction of this Honourable Court, directing an enquiry
under Order 20 Rule 12 of Code of Civil Procedure, 1908, to
derive and determine the mesne profits payable by
Defendant for unlawful use and occupation of the Suit
Premises, at such rate as this Honourable Court may deems
fit and proper, till the time Plaintiffs recover the possession of
Suit Premises being Room No. 1, Ground Floor, Bhuta Nivas
No. 1, Dr. Ambedkar Road, Matunga, Mumbai-400019,
admeasuring approximately 229 sq.ft. area, situated upon

AND WHEREAS, the Plaintiffs abovenamed have taken
out Injunction Application on 11ᵗʰ June, 2025 i.e. Exhibit No.
09 praying therein that it is just, necessary and expedient
that pending the hearing and final disposal of the suit, the
Defendant by himself, his servant, agents, or anyone on his
behalf be temporarily restrained by order and injunction of
this Honourable Court from disposing off, selling,
transferring, or parting with or creating third party rights or
interest of any nature whatsoever in respect of the Suit
premises being Room No. 1, Ground Floor, Bhuta Nivas No.
1, Dr. Ambedkar Road, Matunga, Mumbai-400019,
admeasuring approximately 229 sq.ft. area, situated upon
Suit Property bearing C. S. No. 754C/10 of Matunga Division
which is bounded on or towards East by Room No. 17, on or
towards the West by Dr. Ambedkar Road, on or towards the
North by Room No. 2, and on or towards the South by Bhuta
Niwas Building No. 2, situated upon the Suit Property, or any
part thereof and for such other and further reliefs, as prayed
in the application.
AND WHEREAS, the Plaintiffs abovenamed have taken
out an Amendment Application on 24ᵗʰ November, 2025 i.e.
Exhibit No. 18 praying therein that Honourable Court be
pleased to allow the present Application and permit to the
Plaintiffs to carryout amendment as per Schedule-I annexed
herewith in the Plaint as well as injunction Notice Exhibit-9
and that the Honourable Court be pleased to condone the
delay if any taking out the present application and for such
other and further reliefs, as prayed in the application.
YOU ARE hereby warned to appear and file your reply
before the Hon’ble Judge presiding in Court Room No. 14,
5ᵗʰ floor, New Annex Building, Small Causes Court,
Lokmanya Tilak Marg, Mumbai-400002, in person or by
authorized pleader duly instructed on the 31ˢᵗ August, 2026
at 2. 45 p. m. to show cause against the Application failing
