As a further update to our intimations and clarifications dated November 21,
2024, November 27, 2024, January 23, 2026, January 24, 2026, January 31,
2026, April 8, 2026, April 18, 2026, May 15, 2026 and May 18, 2026
In relation to the criminal indictment (No. 24-CR-433) filed before the United
States District Court for the Eastern District of New York (“US Eastern District
NY Court”) by the United States Department of Justice (“US DOJ”) in the case
of the United States of America against Mr. Gautam S. Adani, Mr. Sagar R.
Adani, Mr. Vneet S. Jaain and other third-party individuals, we would like to
inform you that the US DOJ filed a motion seeking dismissal with prejudice of
the charges in the indictment against Mr. Gautam S. Adani, Sagar R. Adani, and
Vneet S. Jaain and other defendants (i.e. a complete dismissal that bars any
prosecution against Mr. Gautam S. Adani, Mr. Sagar R. Adani, Mr. Vneet S.
Jaain and other defendants for the same allegations and the case cannot be
re-opened). The US DOJ further reviewed the charges and decided in its
prosecutorial discretion to dismiss this case. In view of the same, US Eastern
District NY Court has dismissed the indictment against Mr. Gautam S. Adani,
Mr. Sagar R. Adani, Mr. Vneet S. Jaain with prejudice pursuant to its order
dated August 10, 2026. Accordingly, the charges in the indictment against Mr.

Pursuant to Rule 48(a) of the Federal Rules of Criminal Proce
dure, the United States of America by and through R.
Trent McCotter of the U.S. Department of Justice (the "Depart
ment") moves to dismiss the Indictment with prejudice as against
all Defendants: Gautam S. Adani, Sagar R. Adani, Vneet S. Jaain,
Ranjit Gupta, Cyril Cabanes, Saurabh Agarwal, Deepak Mal
hotra, and Rupesh Agarwal ( collectively, "Defendants"). 1 (Dept's
Rule 48(a) Mot. to Dismiss Indictment C'Rule 48(a) Mot.")
(Dkt. 23).)
For the reasons explained below, the court GRANTS IN PART the
Department's Rule 48(a) Motion.2 Counts Two, Three, and Four
of the Indictment as alleged against Defendants Gautam Adani,
Sagar Adani, and Jaain (collectively, "Appearing Defendants")

are DISMISSED WITH PREJUDICE. The court RESERVES JUDG
MENT as to the portions of the Motion regarding Counts One and
Five as alleged against Defendants Gupta, Cabanes,
Saurabh Agarwal, Malhotra, and Rupesh Agarwal ( collectively,
"Non-Appearing Defendants"), pending the Department's fulfill
ment of Rule 48(a)'s requirements.
