SEIL/Sec./SE/2024-25/88 dated February 4, 2025, informing about the receipt of demand notice from Joint commissioner, Noida Tower II, Ground Floor, IGL Complex, Noida Uttar Pradesh- 201301, relating to wrong availment of excess Input Tax credit in TRANS1 for financial year 2017-18 and accordingly, demanding the excess amount along with the interest and penalty, as communicated earlier. In this regard, we wish to inform that the Company has now received an appeal order vide no. NOI-CGST-001-APPL-324-2026-27 dated July 29, 2026 from the Office of the Commissioner, CGST (Appeals), Noida - 201305, regarding wrongful availment/transition of ineligible CENVAT credit (Education Cess, SHE Cess and Krishi Kalyan Cess) through TRAN-1 under Section 140 of the CGST Act, 2017 and wrongful availment of transitional credit on hotel booking facilitation services without establishing business nexus. The Company is evaluating appropriate legal remedy. The required details pursuant to sub-para 20 of Para A of Part A of Schedule III, are as follows: Sr. Particulars Details 1. Nature and details of the The Company had carried forward transitional credit through Form GST TRAN- action(s) taken, initiated or 1 under Section 140 of the CGST Act, 2017. Pursuant to audit observations, order(s) passed; proceedings were initiated alleging wrongful transition of certain credits. The Department contended that (i) Education Cess, Secondary & Higher Education Cess and Krishi Kalyan Cess amounting to INR 9,57,641/- were not eligible for transition under GST, and (ii) input tax credit of INR 2,58,549/- pertaining to hotel booking facilitation services lacked evidence of business nexus and was therefore inadmissible. The adjudicating authority confirmed the above demands along with applicable interest and penalty. Upon appeal, the Commissioner (Appeals), CGST Noida, vide Order No. NOI- CGST-001-APPL-324-2026-27 dated 29.07.2026, partly allowed the appeal by setting aside the demand of INR 2,83,584/- relating to transit invoices recorded on 31.07.2017.
