Brief facts of the case: JK Agri Genetics Limited (“the Company”) has entered into a comprehensive wholesale agreement with Respondent for supply of agricultural seeds, encompassing market promotion and brand marketing. In the Kharif 2018 season, the Respondent procured Paddy Variety JKRH-333 seeds on credit amounting to Rs. 9.51 crores. After deducting all discounts, incentives, and credit notes, the net amount payable by the Respondent is Rs. 4.62 crores. The Respondent made part payments totalling to Rs. 3.94 crores, with last payment made in the first week of August 2023. Currently, a balance of Rs. 67.74 lakhs remain outstanding for payment. Accordingly, the Company demanded payment of the outstanding balance of Rs. 67.74 Lakhs on which the Respondent refused to pay. Following multiple correspondences, the Company issued a legal demand notice dated 25th May 2026 for the payment of the outstanding balance of Rs. 67.74 Lakhs and for invoking the arbitration clause to resolve the dispute. The Respondent subsequently disputed the claim via email and a reply notice dated 3rd July 2026. The Company has filed an application before the Hon’ble High Court of Telangana at Hyderabad under Section 11(5) and 11(6) of the Arbitration and Conciliation Act, 1996, seeking the appointment of an Arbitrator to resolve the dispute and the case got listed before the Hon’ble Court on 8th October 2026. 2.
