The order is regarding a) non-payment of duty of export of services due to non-receipt of convertible foreign exchange, b) availment of ineligible ITC, c) non-payment of GST for supply made to SEZ without endorsement and d) non reversal of ITC as per credit notes reflected in GSTR2A. The Authority has order(s) passed; confirmed the following tax demands and penalties: 1. Demand of IGST of INR 2,37,99,374 towards alleged non-payment of IGST on export of services due to non-receipt of export proceeds within the prescribed period. 2. Demand of IGST of INR 1,06,37,269 towards alleged availment of ineligible input tax credit. 3. Demand of IGST of INR 3,79,519 towards alleged non-payment of GST on supplies made to SEZ units without prescribed endorsement of the authorized officer. 4. Demand of INR 3,63,915 towards alleged non-reversal of input tax credit related to supplier credit notes. 5. The Authority has dropped the proposed demand of INR 67,316 relating to alleged duplicate availment of ISD credit. 6. Interest has been directed to be recovered at applicable rates and a penalty of INR 35,18,008 has been imposed under Section 122(2)(a) read with Section 73(9) of the CGST Act, 2017.
